We just got back from Newport beach where we exhibited at this year’s EB-5 Investors Conference and accepted the award for Top 5 Business Planner in the EB-5 industry.

For those unfamiliar, EB-5, its essentially an immigration program that fuels an alternative capital market for developers and entrepreneurs. By leveraging investments from foreign high-net-worth individuals seeking U.S. green cards, this program offers many who know that they are doing a competitive advantage by significantly lowering their cost of capital.

With Paul Atkins now leading the SEC, the pendulum is shifting towards a more business-friendly regulatory framework. Over the past few years, stringent compliance measures burdened broker-dealers and project sponsors, limiting their ability to facilitate EB-5 transactions efficiently.

This anticipated easing of regulations will allow regulated players a freer hand to generate new interest in the EB-5 program, fostering innovation and growth. With greater flexibility, industry players will be better equipped to develop and market projects, ultimately driving more investment into the U.S. economy.

Immigration Challenges Under Trump Administration:

arrow-1 Competing forces are at play. Steve Muller’s and Trump’s rhetoric may challenge investments from China with stricter oversight on source-of-funds processes and reduced USCIS and overall government staffing.

arrow-1 These factors could create bottlenecks and longer processing timelines especially for oversubscribed countries like China, Vietnam and India. However, Trump’s generally positive stance on legal immigration, including EB-5, suggests bipartisan support for the program, particularly as a potential funding source for disaster zones. He’s spoken favorably towards H1Bs and even suggested giving foreign college graduates green cards. I don’t see either of this happening but it signals he act favorable towards the EB-5 program.
